Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "Customer") and MAP Platform FZE ("MAP Platform", "we") governing your use of AgentiCRM (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Account and eligibility

You must be at least 16 years old and able to enter into a contract. You are responsible for keeping your credentials secure and for all activity under your account.

2. Subscriptions, trials, and billing

• Paid plans renew automatically at the interval shown at checkout until cancelled.
• Trial accounts convert to paid plans only with your explicit consent.
• Usage-based services (AI messages, voice minutes, SMS, email) are billed from your wallet balance.
• Refunds are handled under our Refund Policy. Payments are processed by Stripe.

3. Acceptable use

You agree not to:

• Use the Service to send unsolicited bulk messages (spam), unlawful, harassing, fraudulent, or misleading content.
• Reverse engineer, scrape, or circumvent technical limits of the Service.
• Use the Service to compete with MAP Platform or to build a competing product.
• Upload malware, infringe intellectual property, or violate any applicable law.
• Use AI features to generate content that impersonates a real person without consent or that violates anti-spam regulations (PECR, GDPR, CAN-SPAM, TCPA).

4. Your data and our data

You retain all rights to the content you upload or generate through the Service ("Customer Data"). You grant us a limited licence to process Customer Data solely to operate and improve the Service for you, subject to our Privacy Policy.

We retain all rights in the Service, including its software, design, and documentation.

5. AI outputs

AI agents inside AgentiCRM generate responses based on your knowledge base and inputs. Outputs may be inaccurate or unsuitable. You are responsible for reviewing AI-generated messages before they are sent in your name and for ensuring they comply with applicable law and your own contractual commitments.

6. Third-party integrations

When you connect a third-party service (such as Google Workspace, Microsoft 365, Twilio, Stripe), your use of that service is also governed by its own terms. We are not responsible for the availability, accuracy, or behaviour of third-party services, and we may suspend an integration if the provider requires us to.

6a. Payments and Merchant of Record

Payments are processed by Stripe on our behalf. MAP Platform FZE is the legal seller of the Service and is responsible for order fulfilment, billing, tax invoicing, and refunds under our Refund Policy.

7. Service availability

We aim for high availability but do not guarantee uninterrupted operation. We may carry out scheduled maintenance and will give reasonable notice where practical.

8. Suspension and termination

You may cancel at any time from Settings. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the platform. You can export your data before cancellation.

9. Warranty disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

11. Indemnity

You agree to indemnify and hold MAP Platform harmless from claims arising out of your Customer Data, your use of the Service in breach of these Terms, or your violation of applicable law.

12. Changes to the Terms

We may update these Terms. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai. The courts of Dubai, UAE have exclusive jurisdiction, except where mandatory consumer protection laws of your country of residence apply.
